The responsibility for correctly submitting an application for a licence to an out-of-commerce work pursuant to Section 51 VGG and adhering to the applicable pre-requisites fundamentally rests with the institution submitting the application. The German National Library excludes any liability for damages incurred through the licensing of works that do not fall under the regulations of Section 51 VGG (only available in German) insofar as the German National Library does not deviate from the published criteria wilfully or to a degree constituting gross negligence.
